What we can review
We can review a range of decisions made by the National Disability Insurance Agency. However, we can only review a decision if it has been internally reviewed by the Agency.
Some of the NDIS decisions we can review are:
that a person does not meet the access criteria
to approve the statement of supports in a participant's plan
not to review a participant’s plan
to approve a person or entity as a registered provider of supports
to revoke an approval as a registered provider of supports
to make, or not to make, a determination about who may do things on behalf of a child
to make, or not to make, a determination that a person has parental responsibility for a child
to appoint a plan nominee or a correspondence nominee.
The decision letter will tell you if we can review the decision.
What we cannot review
a decision that has not been internally reviewed by the Agency
every decision that the Agency makes.
How to apply
You can apply online, fill out an application form or write us a letter, and send it to us by post, email or fax. We can help you complete your application if you need assistance.

Filling out the application form
The application form is available on our website or you can ask us to send you one. It will help us if you attach a copy of the decision to your application.
Writing us a letter
If you write a letter or email, make sure you include:
your name, postal address telephone number and email address
the date you received the decision
brief reasons why you think the decision is wrong; and
a copy of the decision
If you can't give us a copy of the decision, then include a brief description of the decision in your letter.
Time limits
Is there a time limit for applying?
Yes. You must lodge an application for review within 28 days after you receive the decision from the National Disability Insurance Agency (the Agency).
What can I do if the time limit has expired?
You can apply to us to extend the time to lodge your application. You must apply in writing and include reasons why the application is late. You can do this:
when you lodge your application for review online; or
by filling in an application for extension of time form and sending it to us with the application for review of decision form; or
by writing an email or letter.
What happens after you apply for an extension of time?
We will send a copy of your extension application to the Agency. They have 14 days to tell us if they oppose the application.
If they do not oppose the application, we will generally make a decision without holding a hearing. If they oppose the application, we will usually hold a hearing before deciding the application. The hearing might be by telephone or in person at the AAT's offices.
We will only start the review if we decide to extend the time limit.
Fees
Do I have to pay an application fee?
No. There is no application fee to apply for a review of an NDIS decision.
