The laws and regulations that govern property transactions can be complex and the consequences of making a mistake can be severe.
Using a qualified solicitor or conveyancer
We recommend you use a qualified solicitor or conveyancer when you:
1 buy or sell property or
2 enter into any other property-related contract.
They'll act on your behalf to:
1 apply for duties assessment and
2 process any payment.
If you don’t have a solicitor or conveyancer, visit
1 Law Society of NSW to find a registered solicitor
2 Australian Institute of Conveyancers NSW to find a licensed conveyancer.
The risks of doing your own conveyancing
We don’t recommend you do your own conveyancing because it comes with significant risks and means you:
1 take on all the responsibility for the sale complying with the law
2 are personally liable if there's a problem
3 may be liable for any losses the buyer or seller incurs due to your error
4 may face technical or legal issues, potentially without recognising them
5 may find it difficult to purchase adequate insurance, because you didn’t use a qualified expert
6 may not understand whether the terms in your sale contract are reasonable.
If you choose to do your own conveyancing, research the requirements, know the risks involved, and understand the sale process and relevant legislation. We don't t give legal advice.
