Types of AAT that can be reviewed

The AAT has the power to review some visa decisions, but it has limited powers. The main categories involved in visas are as follows:

Family Reunification Visa

This includes the review of applications for spouse visas, parent visas and other family reunification visas.

Employer-sponsored work visas and immigrant visas

Involves the approval and review of the Employer Nomination Scheme (ENS), the Regional Skilled Migration Scheme (RSMS) and other related visas.

Relative-sponsored tourist visas

For short-term visitor visas sponsored by relatives in Australia, including for family visit and tourism purposes.

A state-sponsored business immigration visa

This includes the application and review of Business Innovation and Investment visas (subclass 188 and subclass 888).

Skilled Migration Visa (submitted in Australia)

It involves the review of visas such as independent skilled immigrants (subclass 189), state nominated skilled immigrants (subclass 190), and remote skilled immigrants (subclass 491).

Student Visa (Submitted in Australia)

Review of student visa applications and decisions lodged in Australia, including visa extensions or eligibility disputes.

Review of visa cancellation or refusal

This includes applications for review of student visas cancelled by USCIS, and denied a bridging visa.

  • Review of decisions to cancel      visas made personally by the Minister of Home Affairs or the Minister of      Immigration

  • If you do not have the right to      apply for a review, you can review the decision.

Please note that the information on this page relates to the review of all visas and visa-related decisions, with the following exceptions:

  • Decisions on protection (refugee)      visas or the outcome of protection,

  • Character-related visa decisions,      and

  • The decision to cancel a business      visa under Section 134 of the Immigration Act.

 

 

What is the statute of limitations for AAT appeal?

 

Notification of refusal in person or by email: 21 days Notification of refusal by mail: 7 working days + 21 days Notification by mail to overseas applicants: 42 days

 

How much does AAT Fees?

If you submit your application before the deadline, you will need to pay AUD 3,374. There is no fee for a bridging visa if the appeal results in the immigration detention of another person; If the contribution is determined to be a significant financial burden, there is an opportunity to reduce it by 50%.


What are the refund rules?

The application is invalid and will be refunded in full; 50% refund if the conditions for reduction and exemption are met; If the appeal is successful, the same will be refunded or 50% of the fees paid.

 

How do I pay the AAT fees?

You can pay the AAT fee in a variety of ways, such as cash, electronic transfer (including EFTPOS), credit card (e.g. MasterCard, Visa), or check or money order. Please note that Australian immigration fees are subject to change from time to time.
